SESTA/FOSTA and AdultWork.com

So how does that work for us UK ladies who are on US websites like Niteflirt and clips4sale?x

I suspect this may well be temporary with AdultWork, as it seems to be a knee-jerk reaction due to panic.

The FOSTA/SESTA, which was signed into law last week, prohibits the advertising of escort/prostitution services online. Now what we need to check, is whether or not AdultWork is hosted on a US based domain. If so; then yes all those offering physical sexual services and based in the US will be affected. If not; then that's where it becomes a bit of a grey area; because AdultWork would then not be classed as a US site and therefore, would not fall under the jurisdiction of FOSTA/SESTA and US Law Enforcement.

Many sites are taking this path to cover their own backs; because the new law hasn't been very well put together. But I will point out that it does relate only to ESCORT services. Cam, media, phone i.e. online services should NOT be affected and I think it's rather bullish of Adultwork's legal team to put all US accounts under the same umbrella.

With regard to Clips4Sale and Niteflirt; I can't speak for c4s as I'm not yet a member - you would have to check directly with them. NiteFlirt have confirmed that arranging to meet with a client for cash, will be a breach of the TOS.

Now to clarify the Skype/Microsoft position.

Nudity has always been against Skype TOS. The "obscene language" bit , is new I believe. Personally; I question the legality of the latter as surely it is against constitutional rights with regard to freedom of speech.

But what I will say is Microsft will not be actively policing accounts; so it's likely to affect you if you are reported by say a disgruntled client. You should be discreet when advertising Skype i.e. don't put your website link on your skype status.

That said; it is wise to take precautions when it comes to Skype and look at possibly other ways to offer private cam sessions - a group of SW are currently researching different ones, so as soon as I know anything; I will advise.

Like I said; I do firmly believe that this will be a temporary measure while AdultWork gain clarity on their legal position in this matter.

I will also point out that there is currently a petition to try and get FOSTA/SESTA repealed. It currently stands at just over 41k signatures. We need 100k signatures, if it's going to make an impact. So whether you're based in the US or not; it's important to sign & stand up for the rights of camgirls and other sexworkers around the world. It doesn't just affect their livelihood. It' affects their personal safety too!

Then they didn't need to suspend US accounts in the first place because it is exempt from FOSA/SESTA. Sounds like the legal team have given them the worst case scenarios and they've panicked.

That would not surprise me. Typical case of them covering their corporate backsides. Understandable, but not surprising.

That's what a lot of sites are doing. Some are doing it out of ill-informed panic. Some are using it as an excuse. An example of this is Fetlife who now won't allow findom and blackmail.

Mostly panic, I would think. Cheaper to shut down problematic areas of their business now, pending confirmation, than have to go to court later. The only winners if that happens is, of course, the lawyers ;(

Definitely. And the lawyers get paid while they "confirm" what we already know.

Unless it's down to the payment processor; which I think it based in the US. From Adultwork's point of view; its far easier to get rid of US models than to disrupt the whole site, while they find yet another new processor.
